Welcome to ABDigitizing. These Terms of Service (“Terms”) govern your use of our website (www.abdigitizing.com) and the purchase and use of our products and services. By accessing our site or making a purchase, you agree to be bound by these Terms.

1. Our Products and Services

We provide three distinct types of digital offerings:

• Digital Embroidery Designs: Pre-made, downloadable digital files for use with embroidery machines.
• Custom Digitizing Service: A service where we convert a customer-provided image (e.g., a logo or artwork) into a custom digital embroidery file.
• Online Digitizing Courses: Educational content, including videos and resources, to teach embroidery digitizing techniques.

2. Intellectual Property Rights & License

All digital content, including embroidery designs and course materials, is the intellectual property of ABDigitizing and is protected by copyright law.

• License Grant: When you purchase a product, you are purchasing a limited license to use the digital file. You are not purchasing ownership of the design itself.
• Permitted Use: You are permitted to stitch out the designs on physical products for personal use or for commercial sale (e.g., on t-shirts, hats, etc.).
• Prohibited Use: You are strictly prohibited from selling, sharing, trading, giving away, or otherwise distributing our digital design files or course materials in any format. Modifying a design does not transfer ownership and does not grant you the right to sell or share the modified digital file.

3. User Accounts

You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account.

4. Payments and Billing

All prices are listed in US Dollars (USD). We accept payments through the methods displayed at checkout. You agree to provide current, complete, and accurate purchase and account information for all purchases made on our site.

5. Refund and Delivery Policies

5.1. Refund Policy
Due to the immediate, irreversible nature of our digital products, we do not offer refunds, returns, or exchanges. By making a purchase on our site, you acknowledge and agree to this policy.

• For Digital Embroidery Designs & Online Courses: Once a purchase is completed and the digital file or course access has been delivered, it is considered used and cannot be returned. Please ensure you have the correct software and embroidery machine to use the files before making a purchase. If you experience a technical problem with a file, please contact us, and we will work with you to resolve the issue.
• For Custom Digitizing Service: Payment is required upfront and is non-refundable once the digitizing work has commenced. We are committed to delivering a high-quality file and offer unlimited revisions at no additional cost.

5.2. Digital Delivery Policy
All of our products are digital. No physical items will be shipped to you.

• How to Access Your Files: After your payment is successfully processed, your files are available for instant download in three ways:
  1. On the Order Confirmation Page immediately after you complete your purchase.
  2. Via a download link sent to the email address you provided at checkout.
  3. Permanently in the “Downloads” section of your ABDigitizing Account.
• Troubleshooting: If you do not receive the email, please check your spam or junk folder. The most reliable way to access your purchases is by logging into your account. Our designs are delivered in a .zip file, which you must “unzip” or “extract” on your computer to access the individual design formats.

6. Terms for Custom Digitizing Service

• The customer is responsible for providing a clear, high-quality image and specific instructions for their custom digitizing request. The quality of the final digitized file is directly dependent on the quality of the source artwork provided.
• Quotes are provided based on the initial request. Significant changes to the request after work has begun may result in additional charges.
• Payment is required before digitizing work begins.

7. Limitation of Liability

ABDigitizing is not liable for any damage to your embroidery machine or to the physical items you are stitching on (e.g., garments) during the embroidery process. We strongly recommend you stitch a test sample of any design on a scrap piece of fabric before embroidering on your final product.

In no event shall our liability to you exceed the total purchase price of the product or service you have paid for.

8. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon being posted to the website. Your continued use of the site after such changes constitutes your acceptance of the new Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia, without regard to its conflict of law provisions.
